Terms of Use

1. Agreement to terms

These Terms of Use ("Terms") govern your access to and use of the Delta Wellness Collective website and patient portal (together, the "Services"), operated from Houston, Texas. By creating an account, booking a visit, or otherwise using the Services, you agree to these Terms.

2. Not for emergencies

Delta Wellness Collective provides non-emergency telehealth services. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Our Services are not a substitute for emergency care.

3. Eligibility and clinical evaluation

Access to treatment is determined by a licensed clinician after review of your intake information and, where applicable, lab results. Delta does not guarantee that any visitor will be found to be a candidate for treatment. If you are not a candidate, your membership is canceled and no further charges apply, though refunds are not available once lab work has been ordered.

4. Membership, billing & pricing

• All services are cash-pay. We accept credit, debit, HSA, and FSA cards; we do not bill insurance.
• Every new patient begins with a one-time onboarding fee covering the initial lab panel and first consultation.
• Memberships require a minimum 3-month commitment, after which they continue month-to-month until canceled.
• Your card on file is charged monthly. A failed-payment fee applies to any declined charge.
• Current pricing for each program is listed on the relevant program and shop pages and is subject to change with notice.

5. Cancellations

Memberships may be canceled at any time after the 3-month minimum commitment, with at least 72 hours' notice before your next refill date. Canceling within the first 3 months incurs a cancellation fee plus the cost of any medication already in your possession. Medication that has already shipped cannot be refunded, consistent with federal law prohibiting the return or resale of prescription drugs. A lab fee applies if labs were already ordered for your next cycle.

6. Prescriptions & pharmacy fulfillment

Prescriptions issued through Delta are filled and shipped by licensed, FDA-registered U.S. compounding pharmacies or brand-name sources. Delta does not dispense or ship medication directly. Compounded medications, including compounded GLP-1 products, are not FDA-approved finished drug products. You must report any missing or damaged item within 48 hours of delivery.

7. Required agreements

Depending on the services you select, you may be required to separately sign a Membership Agreement & Billing Disclosure and/or an Add-On Services Agreement & Billing Consent before treatment begins. 8. Your responsibilities

• Provide accurate, complete, and truthful information during intake and follow-up visits.
• Use medications only as prescribed and inform your care team of any side effects or changes in your health.
• Keep your account credentials confidential and notify us of any unauthorized use.

9. Intellectual property

All content on this website, including text, graphics, and logos, is owned by or licensed to Delta Wellness Collective and may not be copied or used without permission.

10. Disclaimers

The Services are provided "as is." While our clinicians use professional judgment in evaluating and treating patients, individual results vary and are not guaranteed.

11. Limitation of liability

To the fullest extent permitted by law, Delta Wellness Collective is not liable for indirect, incidental, or consequential damages arising from your use of the Services, beyond the amount you paid for the services giving rise to the claim.

12. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

13. Changes to these Terms

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
